US Swimmer Has Suspension Reduced

US swimmer, Jessica Hardy, has had her suspension reduced to one year by the American Arbitration Association.

Hardy’s suspension stemmed from a positive drug test at last year’s Olympic trials in Nebraska. Hardy tested positive for the banned substance Clenbuterol.

In addition, the AAA has announced that if the suspension would preclude her from being able to compete in the 2012 Olympics, it would be wiling to review additional evidence surrounding the positive test.

Hardy’s suspension was reduced because there was evidence that the positive test was a result of a contaminated supplement sample.

According to Swimming World Magazine, this is the second such reduction of a suspension because of a contaminated supplement. Kicker Vencill had a four year suspension reduced to two, as the result of a lawsuit providing that Vencill lacked the requisite intent to use the banned substance.

Former Student-Athletes Sue EA Sports Over Video Game

A class action lawsuit has been filed against video game retailer EA Sports. The maker of the popular NCAA Football video game has been sued by a group of former student athletes.

According to SF Weekly, the lead plaintiff is Sam Keller, a quarterback at Arizona State and Nebraska. The article states that:

“The suit in its first sentence [states] that it ‘arises out of the blatant and unlawful use of student likenesses in videogames produced by [EA]…to increase sales and profits.’ This, the complaint continues, is abetted with a wink-and-nod assist from the NCAA, which ‘intentionally circumvents the prohibitions on utilizing student athletes’ names in commercial ventures by allowing games to upload entire rosters, which include players’ names and other information, directly into the game in a matter of seconds…

This, the suit alleges, is a symbiotic relationship between the NCAA and EA that leaves the student athletes – who make this whole venture possible – empty-handed.”
